  1. That Zachariah Todd of Dorchester County has departed this life intestate leaving Marcellus Todd, George Todd, Mary Todd, Caleb Todd, Zachariah Todd and Levin Todd his heirs….(infants under twenty one years of age) letters of administration in his personal estate have been granted to Benjamin T. Street.  20 June 1831  George Todd one of the heirs had removed out the state of Maryland: 22 July 1832

  5. 27 Mar 1833:  The farm..where the widow of Zachariah Todd lives containing about 40 (acres?) was sold to George Todd for $91:00 cents
  6. Where the mother of Zachariah Todd lives was sold to Robert Hurt for ten dollars
  7. 23 July 1832: The bill states that Zachariah Todd hat departed this life intestate leaving Marcellus, George, Mary, Caleb, Zachariah and Levin Todd, his heirs at law and that letters of administration on his personal estate have been granted to Benjamin T. Street and that the said Zachariah Todd at the time of his death was indebted to the complainant and that his personl estate is insufficient for the payment of his debts.  IT is also stated by petition that since the filing of the Bill George Todd hat removed out of the state of Maryland. 
  8. NOTE:  Zachariah Todd md Sophia Todd in 1809 and appears in the 1820 census as having 3 sons born before 1820, including one born prior to 1810.  A George Todd born 1813 would have been 19 years old in 1832 and hence old enough to have left the state, but still underage.
  9. (ED NOTE: The 1850 census indicates Caleb was born ca 1821, Zachariah born 1826, and Levin born 1829.)
  10. Henry Page was trustee for case and Benj. Street was administrator of estate of Zachariah Todd.

 

2.          11693:  John A. M Woodland vs Mary A., Maria E. Levin M. Solomon E. and Mary B. Todd: John G. Todd’s Estate, Dorchester 1842, William Rea, Trustee, Liber 159-538

    1. ..John G. Todd late of Dorchester County departed this life ..1841 intestate..John G. Todd left no personal estate and died seized of a small real estate lying in Dorchester County.
    2. Handwriting in this case is close to illegible, but it seems like John A. M. Woodland was suing the estate of John G. Todd for $105.
    3. Henry Page was initial trustee but he died and court appointed William Rea trustee. (ED NOTE:  Henry Page was also trustee for Zachariah Todd estate.)
    4. (Ed Note: Could not tell if the two Mary’s were mother and daughter or not.)
    5. (ED notes:  John G. Todd is listed in 1830 census, but not 1840 census for Dorchester Co.  The 1830 census indicates he had a son b 1815-1820.)
    6. (Ed notes: There is a John G. Todd who married Alienda Woodland in Dec 1820.)

a.       L__dy Insley aged 60..that the lightwood stump he now shows was shown to him about 30 years  past as a line__ by Michael Todd: 9 Nov 1809  Lovey Insley

b.      Thomas Todd, aged 34 years.. that the Lightwood stump he now shows was shown by the deponent by his father Michael Todd as one of the lines of Safford.  9 Nov 1809

c.       It is alleged by the caveat that a part of the vacancy contained in the certificate of Mirtle Swamp is __ by an __ tract of land called Safford… some difficulty in the location of Safford as located on the plat offered in evidence.  Safford may__line more than its certificate calls for.  Safford calls for a tract of land..the weight of this evidence seems to be in favor of the caveat or the case depends on the true location of Safford.  The judge does not deem himself authorized to act finally on it, but think the subject ought to be left open for the investigation of a court jury.  9 July 1810.

d.      In June 1809, John S. (or L.) McNamara challenged the survey made by John Street with respect to the location of the line that formed the boundary between Mirtle Swamp and Safford.  Street had his land resurveyed in Nov 1809 and McNamara had his lands resurveyed In Nov 1809 and Jan 1810.

By virtue of a warrant of Resurvey granted unto John Street of Dorchester County bearing date the 6 June 1808 to resurvey a tract of land called Todds Luck originally on the 26 July 1768 granted unto Michel Todd for 76 acres Also a tract of land called Lightwood Swamp originally on 31 Jan 1762 granted unto Solomon Woodland for 15 acres as may appear…find them to contain as follows:

Todd Luck contains 76 acres and Lightwood Swamp contains 15 acres-3-1/2 I find taken away by an elder survey called Lakes Hazzard- all of which land taken away I have included and have bye the authority aforesaid added unto  said parcels of land 35 acres of vacancy which lay .. and have .. the whole into one Intire Tract now called Mirtle Swamp - lying and being in Dorchester County and near the head of a creek called Ferrim Creek that makes out of Fishing Bay- Beginning for the outlines of the Whole Tract at a marked oak in the woods it being the boundary of Lakes Hazzard and from there runs

Rezin Todd of Anne Arundel Co, MD

 

In a 1789-1792 Chanery Court case involving the sale of a portion of “Rebecca’s Lot” in Anne Arundel County, it was established that Rezin Todd was married to Sarah Griffith and had the following eight children:

2.      Nancy b ca 1765

3.      Sarah b ca 1767

4.      Ruth born ca 1769

5.      Henry b ca 1771

6.      Rhesa b ca 1773

7.      Rachel b ca 1775

8.      *Sophia b ca 1779

9.      John b ca 1782

 

Since Lancelot Todd had bequeathed Rebecca’s Lot to his sons John and Lancelot and since this John Todd and his wife Ruth had a son Rhesa Todd, it is assumed that this Rhesa Todd is the son of John and Ruth Todd.

 

Henry Griffith of Montgomery Co, MD was identified as the grandfather of Henry Todd.  A deposition taken of Mrs Sarah Todd in Montgomery Co identified her as the mother of Henry and the other children.

 

Henry Griffith was guardian of Henry Todd who declared a Lunatic and incapable of conducting business affairs.  Henry had suffered fits since the age of 5 and was now 18.  Henry was the oldest son and hence heir-at-law of the estate of Rhesa Todd. Rhesa Todd of Anne Arundel County had mortgaged his portion of Rebecca’s Lot in Anne Arundel Co. on 14 December 1771 to John Dorsey to be paid by the following August.  Rhesa died intestate prior to 1789 and had not paid off the mortgage.  The court directed the guardian of Henry Todd as heir-at-law to sell the portion of Rebecca’s Lot to pay off the mortgage.  The court had the land sold to the highest bidder (Edward Dorsey of Anne Arundel Co) in 1791.

 

                            Montgomery County Ss.  An inquisition taken at  the house of Mrs. Sarah Todd in the County aforesaid this twelfth day of February before Benjamin white Jones Sheriff of the county aforesaid by Virtue of  a commission in nature of a writ de lunatus inquirendo? under the seal of the High Court of Chancery of Maryland to me the said Benjn W. Jons directed to enquire amongst other thing of the Lunacy of Henry Todd of Montgomery County aforesaid upon the oaths of Greenbury Griffith Senr John Barber Senr, John Barber Jr, Basil Pool Senr, Joseph Waters Nezekiah Griffith Amon Riggs Howard Griffith-------- Thomas Windsor, Greenbury Griffith Jrs, Richard Berry?  Holland and Basil Pool Jr. Good honest and lawful

men of the County aforesaid who being sworn and upon there oaths say that the said Henry Todd  is at the time of taking this inquisition a lunatick and that he is not capable of governing himself or his Estate his lunacy was ?oriasioned? by Fits ever since he was five years of age and he is now in his eighteenth year from the best information we can obtain, the  Jury upon there oaths say they have not been Personally acquainted with him longer then three years.  In November past and the said jurors upon thereon Oaths further say that they do find that the said Henry Todd hath not aliened any lands or tenements during his lunacy    aforesaid to there knowledge the said jurors also find (there is a fold in the page over this line) sd Henry Todd as Rhesa Todd in his sixteen year Elizabeth in her twentyseventh year Nancy in her Twenty fourth year Sarah in her  Twenty second year Ruth in her twentyeth year Rachel in her fourteenth year Sophia in her tenth year and John Todd in his seventh year of his age who are his brothers and sisters of the aforesaid Henry Todd  In Witness whereof I the said Benjamin White Jones with the Jurors aforesaid have hereunto set our hands and seals the day and year above_______

  1. John Dorsey a Henry Todd heir of Rhesa Todd deceased, July 13 1790

 

This Indenture made this fourteenth day of December Anno Domini one thousand seven hundred and seventy one between Rhesa Todd of Anne Arundel County planter of the one part and John Dorsey of the said County Merchant of the other part. Witnesseth that the said Rhesa Todd for and in consideration of the sum of one hundred and thirty five pounds sterling to him in hand paid by the said John Dorsey at and before the sealing and Delivery of these presents - the receipt whereof the said Rhesa Todd doth hereby acknowledge and thereof and therefrom release acquit exonerate and discharge the said John Dorsey his executors, administrators and assigns - Hath given granted bargained and sold and by these present both give grant bargain & sell unto him the said John Dorsey his heirs and assigns for ever. All that tract or parcel of land called Rebecca’s Lott lying and being in Ann Arundel County with the appurtenances and the _________ and reversions remainder and remainders rents issures and profits and all the estate right title and interest of the said Rhesa Todd of in and to the said land and premises with the appurtenances. To Have and To Hold - the said land and premises with the appurtenances to him the said John Dorsey his heirs and assigns forever. Provided always and these presentia__ upon this express condition that if the said Rhesa Todd his heirs executors administrators or assigns sahll and will well and truly pay or cause to be paid unto the said John Dorsey his executors or administrators the full sum of one hundred and thirty five pounds sterling with legal interest for same on or before the first day of August next, Insuing the rate hereof that then and from thenceforth these present and every matter & thing herein contained shall cease determine and be utterly null and void to all intents and purposes any thing herein contained to the contrary thereof - notwith- standing and the said Rhesa Todd for himself his heirs, executors and administrators doth covenant promise grant and agree to and with the said John Dorsey his executors, administrators and assigns that he the said Rhesa Todd his heirs executors administrators or assigns shall and will well and truly pay or cause to be paid unto the said John Dorsey his executor administrators or assigns the aforesaid sum of one hundred and thirty five pounds, sterling with legal interest for the same on or before the said first day of August next according to the true intent and meaning of these present. The state of Maryland To the Sheriff of Montgomery County, Greeting, Because we have received information, that Henry Todd of Montgomery County is foolish, and a Lunatick, so that he is not sufficiently able to govern himself, his goods and Chattles and that he hath been so for many years and that he is utterly incapable of managing and taking car of his property to his own detriment and our manifest prejudice— We being willing to take care for indemnity of him the said Henry Todd, in his behalf, command you, that, you diligently inquire, by the oath of Honest and Lawful men of your Bailiwick by whom the truth of the matter may be better known whether, the said Henry Todd, be foolish and a Lunatick as is before said, or not, and if he be, then, whether, from his nativity, or from any other time, and if from any other time, then from what time, and how, and in what manner, and if he enjoys Lucid intervals and whether he the said Henry Todd, being in such condition, aliened any lands or tenements, and where, and tow whom; or what persons, and in whose hands or what persons hands, the Lands and Tenements, so aliened are and how, and in what manner, and what tenements so yet remain: and of whom or what persons, as well the lands and tenements so aliened as the lands and tenements retained to himself are holden, and by what services and how and in what manner, and how much they are worth, by the year in all issues, and who is his rent kin?, and of what age, and the in question, thereof distinally? and openly made, send to us in Our High court of Chancery, under your Seal and the Seal of those by whom the same Inquisition is made and taken and this wit? Case 5052 Rezin Todd by Francis Cromwell vs Thomas Drane, Anne Arundel Co, 1801

 

1.      Bill of complaint of Rezin Todd a minor by Francis Cromwell his guardian… that Rezin Wright on 6 July 1764 made his last will and testament..divided his estate real and personal to his wife for life remainder, to her three children by a former husband in fee to wit, John Todd, Lancelot Todd and Sarah Todd as tenants in common.  That the said Sarah married a Drane by whom she had one son named Thomas Drane (Ed. Note: this is amended in a later filing to say that she had two sons James and Thomas).  That shed died about 1786 intestate leaving the sd Thomas Drane her only son.. that the said Lancelot Todd died in or about 1793 intestate without issue; that John Todd had two children, your petitioner and Mary Todd, both minors.  John died in the year 1788 leaving your petitioner and his sister heirs at law.. that the land of ..said Wright was called Hall's parcel..100 acres..land..half to Drane and the remaining equally to be divided between your complainant and his sister.. whole of land has been in possession of said Thomas Drane.

2.      Your complainant states .. that the said Sarah Drane left two children James, the oldest and Thomas the youngest, that James and not Thomas is the heir at law.

3.      Mary Todd, a minor of Baltimore County by Thomas Drane, her guardian.. that Rezin Wright by his last will and testament devised the land in the bill mentioned to John Todd, Lancelot Todd and Sarah Todd as stated, that Sarah Todd married a certain Drane and that she died about the year 1786 and left Thomas Drane her heir at law, that Lancelot Todd died in the year 1793 in3testate and without issue; that John Todd died about the year 1788 and left Rezin Todd, the aforesaid complainant and Mary Todd, the defendant his heirs at-law.  She further admits that no division was ever made and that she is willing it should now take place.  She states that John Todd her father and Lancelot Todd in their lives held the exclusive use of the land.  Baltimore county 21 Aug 1802.

4.      21 Aug 1802: George Conaway (by commission) appointed Thomas Drane guardian of Mary Todd to answer the bill of Rezin Todd by Francis Cromwell.

5.      The separate answer of Thomas Drane.. that Rezin Wright executed his will and devised his real estate.. that he admits that Sarah Todd married James Drane (Thomas Drane is written and crossed out) and that she died some years ago leaving two sons the defendant and his brother James.  That the said John, Lancelot and Sarah during their lives lived on the said land, tended it and sold the wood off the same and that the said land was never divided.  That he hath been in possession of the said land ever since the death of the said Lancelot Todd and that he hath cultivated the same and that the said land is very poor and he hath never made sufficient for his support and that the defendant is willing that the said land be divided.  Baltimore County 21 Aug 1802, witnesses: Justice of the Peace, Owen Dorsey

6.      Eleanor Wright by her petition .. that she is possessed of a tract of land called Hall's Parcel..North side of Magothy River in Anne Arundel county (she requested establishment of the boundaries)  22 Dec 1770.

7.      George Sill, aged 64 ..27 years ago came with Henry Wright who said this was his land…and 19-20 years ago.. came with Rezin Wright..heard that the post was in the first course of sd Rezin Wright's land.

 

 

Baltimore /Anne Arundel Todds


Hanson's Wood Lot was a property in which Thomas and Phillip Todd were
involved in between 1795 and 1797.  The following references may shed some
light on the location of this land and its transferal history that may in
turn shed light on the Todd involvement in that land.

The Ensor family was involved in a deed transaction with Benjamin Todd in Anne Arundel Co also.

Sophia's Garden was land in which Samuel, Thomas and John Todd as well
as Benjamin German were involved with between 1804 and 1807.  Some
historians believe this family is the family of John Todd who married Mary
German/Jarmain.

I Jonathan Hudson of the County of Baltimore, Merchant am held and firmly bound unto Benjamin German, Junr David Parlett and Benjamin German Senr in the sum of 1000 pounds.. to be paid to the said Benjamin German, Junr David Parlett and Benjamin German Senr…to which payment I bind myself ….19 Oct 1785, whereas the aforesaid Jonathan Hudson hat bargained and sold to the aforesaid Benjamin German Junr David Parlett and Benjamin German Senr.. part of a tract or parcel of land situate in Baltimore county called Sophia’s Garden regulated, it being that part distinguished ..by the number 3 containing 133 acres at the rate of 58 shillings …per acre..If the above bound Jonathan Hudson do and shall convey and make over to the said Benjamin German Junr and David Parlett by deed containing a clause of special warrantee, the said Benjamin German Junr David Parlett and Benjamin German Senr paying the purchase money therefor, then the above obligation to be void else to remain in full force.

c. ...the petition of Benjamin Germain Junior and David Parlett of Baltimore County farmers .. that your petitioners jointly purchased of Jonathan Hudson of Baltimore Town a lot of gorund distinguished by the Nubmer three being part of a tract of land called Sophias Garden Regulated on or about the 19 Oct 1785 containing by estaimte 133 acres of land more or less at 58 shiling.. per acre and gave their joint bond to the said Jonathan Hudson for the purchase money thereof together with Benjamin Germain Senior as their security and received from the said Jonathan Hudson his bond of conveyance for the same lot number three

You petitioners further show that the said Jonathan Hudson departed this life intestate before he conveyed the said lot of land leaving a son named Jonathan Hudson his heir at law who is an infant that the said Jonathan Hudson deceased had only an equitable right and title to the said land at the time of his death which hath since his decease been conveyed unto Jonathan Hudson the heir at law aforwaid  Your petitioners further … that Margaret Hudson administrator over the estate of the said deceased Jonathan Hudson and proceeded to sue your petitioners in the General Court for the Western Shore of this state on the Bond given by them for the said purchaser and hat obtained judgments against your petitioner of the full sum of principal and interest.

Your petitioners further .. that the said lot of ground no 3 hath since the death of the said Jonathan Hudson been surveyed by James Baker deputy surveyor of Baltimore county at the instance of the said administratrix and is found to contain no more than 118 acres of land that your petitioners are ready and willing to pay the amount thereof with interest on receiving a deed for the same .. to their Bond of Conveyance but there is no person in whom any power is vested during the minority of the said Jonathan Hudson  the infant to convey the said land to your petitioners.

Your petitions therefore pray that subpoena may .. against the said infant to appear and .. the premises and that the said infant by his guardian may be compelled to convey the said 118 acres to your petitioner and so forth.

  1. Thomas Todd d 1716 had 4 gold rings in his lengthy inventory and Lancelot Todd, Jr was listed as an appraiser.
  2. Lancelot Todd d 1792 had Thomas and Phillip listed as kindred.  Thomas Todd was the administrator.  Thomas and Phillip appear in 1794 as Phillip Todd of Baltimore County, shoemaker in connection with Gallon Burrow or Roger's Inspection near Baltimore Town, Lots 85, 86 on  Bridge Street and later in 1799 with respect to the same parcel and also in 1797 in association with Thomas Todd and Hanson's Wood, with Owen Dorsey a witness.
  3. Richard Todd inventory of May 1798 and 1799 had no family info.
  4. Owen Todd Inventory of July 12, 1803 made reference to his half of the lott in George Street Fells Point, Baltimore. Administrator of Owen Todd was Thomas Bissett.  (This Owen Todd was recently married to Miss Bissett.  He was the son of Joseph Todd of who had died in York Co, PA in 1793. Joseph had bought or leased land on George Street for 99 years in 1782)
  5. Thomas Todd 1808 was appraised by Nicholas Grimes and Alexander Tracy.

Between 1738 and 1746.  The index lists the marriage of Lance Todd and Rachel Warfield, but not the marriage of John Todd and Ruth ?. 

 

The index does not list any of  the family ofThomas Todd, the brother of John and Lance.

Nor does it mention Benjamin Todd b ca 1749.

 .           Lance Todd to Alexander Todd: Book BB No 2, p 163 (LDS film 13215)

I Lance Todd of county aforesaid planter..for ..22 pounds being in part of a judgment decree against me in Ann Arundel County Court by Charles Ridgely of Baltimore County on a bond due to the estate of Doctor Samuel Stringer the receipt whereof I do hereby acknowledge before the ..and delivery of these presents.  Now be it known that I Lancelot Todd Sen do  bargain, ___ and make over to Charles Ridgely one sorrel mare branded IT, one roan horse of the same brand, three cows marked with a cross and hole in the right ear and ..four sheep with the same  mark, three feather beds and furniture , a Cart, six __, three painted dishes, and six plates,  two tables, four iron pots, and pot hooks, two iron pot ?  and a pair of iron ? to have and to hold the same bargained premises to the said Charles Ridgley.  It is the true intent of these presents that the said Lancelot Todd will well and truly pay Charles Ridgely on 1 Aug 1761 the sum of 22 pounds then these presents shall be void.  31 July 1758

Whereas Alexander Todd of the Same county at the request of me the said Lance Todd, Sr became my security on the first day of June last to Mr. John Ridgely of Baltimore County merchant for the payment of the full sum of 16 pounds fifteen shillings and all the costs of suit .. on an execution obtained in Ann Arundel County Court for the aforesaid money also two shillings to me in hand paid by the said Alexander Todd, the receipt whereof is hereby acknowledged do grant unto Alexander Todd all my crop of corn and Tobacco now growing on the plantation where I know live and on the plantation where Daniel Bell rents(?) from, also on a plantation rent of Thomas cockey and Black mare branded I.T. two sows twelve pigs, and Goats (?)  It is the intent of these presents that I Lance Todd will pay unto John Ridgely the aforesaid sum of 16 pounds, fifteen shillings before the last day of July 1759 then this deed shall be void.

17 Sept 1804 Thomas Drane and Mary Todd of Anne Arundel County and George Conaway of said county..Thomas Drane and Mary Todd for $450 paid by George Conaway..doth grant..that part of a tract of land called Hall’s Parcel lying on the North side of Magothy River and on the east side of a creek called Bailleys Creek in Anne Arundel County.  Beginning at the head of a small marsh, where originally stood a Boundy.. hickory tree, .. or stakes or stake and bounding on said creek lying up Northand by West 50 perches to a bounded Redoak, thence Norht and by east 395 perches, then South and by East 50 perches then with a straight line to the first bounded tree..100 acres..in the presence of James Mackubin, Lewis Duvall …recorded 17 Sept 1804

Section 8

 

Dorsey Family and connection to Todd Family

  1. The Todd families of Baltimore and Anne Arundel Counties, Maryland were linked with three different Dorsey families, Caleb Dorsey of Baltimore Co., Edward Dorsey, son of John Dorsey, of Anne Arundel County and Edward Dorsey, son of Edward Dorsey, of Anne Arundel Co.
  2. The Thomas Todd family was linked to Caleb Dorsey in that Caleb's daughter Eleanor married first to Thomas Todd and then after his death married ca 1740 to William Lynch.
  3. The daughters of Lancelot Todd, namely Sarah and Ruth married Edward Dorsey and Michael Dorsey, respectively, but these two Dorseys were not brothers.  Sarah Todd married Edward Dorsey 1701-1767, son of Edward Dorsey 1768-1702 and Ruth (Hill?) d 1735.  Sarah Todd's sister Ruth married Michael Dorsey son of John Dorsey 1688-1764.    
  4. At this point, all we can say is that Benjamin Todd md Eleanor Ford 1781 of Baltimore and later Anne Arundel County MAY be related to the Anne Arundel Co family based (1) on the business dealings with Edward and Ezekiel John Dorsey who were brother-in-law and nephew of Ruth Todd who married Michael Dorsey, and (2) the fact that the Fords were an Anne Arundel Co family.
  5. The reference to Thomas Todd being buried in 1794 at Samuel Norwood's suggests a possible link to the Anne Arundel Co Todds as well.  There is a Samuel Norwood who married a great-niece of Ruth Todd.
  6. The Dorsey relationships upon which this analysis is based were not documented in the sources used, but documentation may exist elsewhere.
