Generation No. 1

 

     1.  John1 Todd was born Abt. 1712, and died Bef. April 1799 in Mecklenburg Co., NC.  He married Margaret Russell ?.  She was born Abt. 1715, and died Aft. June 1800 in Mecklenburg Co., NC.

 

Notes for John Todd:

 

      The oldest Todd we have been able to identify in Mecklenburg County is this John Todd who left behind him a large and diverse family. The first record found to indicate the presence of this family in the county is dated 1766, when John's son James was a 2nd chain bearer on a survey of land for John Hartness on Bullock's Creek, and over the next two hundred plus years Todds married into and interacted with about every family in the county. When John Todd brought his interesting and prolific family to North Carolina and from whence they came are facts that elude our humble research.

 

An earlier version of the history of this family concluded that the family had a sojourn in Lancaster County Pennsylvania prior to coming to North Carolina.   This was based upon assuming that one Elizabeth McClure had been born a Todd and married Thomas McClure in Lancaster County PA.  

 

A note found in the estate papers of Hugh Todd. " Elizabeth Mcluer Alias Todd personaly came before me and made Oath that she heard Hugh Todd say that he had got a half -- Johannes from a good old friend and she believes it was from his mother Margaret Todd and she Believes the same due yet to his Mother sworn before me this 12 day of Decr 1793 [signed Jas Tagert JP and Elizabeth/her mark/ MCluer."   

 

Later research revealed that Thomas McClure’s wife was Elizabeth Moorhead, not Todd.   Also, John Todd d 1799 does not mention a daughter named Elizabeth in his will.    Hence there is no longer any evidence for a Lancaster origin.   

 

RMcMurtry wonders if this Elizabeth could have been Hugh’s widow and that she remarried to a Mcclure.

 

Another origin theory postulates that John Todd of Mecklenburg County was the same John Todd that baptized children at Abington Presbyterian Church and First Presbyterian Church in Philadelphia between 1725 and 1736.   This latter family is not found later in New Jersey or Pennsylvania records giving rise to the theory that they migrated to another colony.     Here is the family structure of these two families compared:

The first name for the Todd birth entry for 1736 at Abington was a blank usually indicating a repeat of the name above, but on one microfilm the name John was written in.  So we are not sure if the name of this child was Alexander or John.

 

The other aspect of these two families is that John was first married in 1724 at Abington Church; so he would have been born about 1700 to 1703 and, in order to have been the John of Mecklenburg, he would have had to have been 96 to 99 years old at this death.

 

So all we can say is that this is a remote possibility, not a certainty.

 

Genetic Origins

 

Recent DNA analysis revealed that the Mecklenburg Todds shared a common ancestor with a Todd family that lived in the early 1800s in Banagher Parish, County Derry/Londonderry.   This Banagher family included an Adam Todd 1782-1851 who migrated to New Brunswick.  Richard McMurtry believes that Banagher is likely the homeland of the Mecklenburg Todds though it is conceivable though less likely that the common ancestor lay back in Scotland.

Notes for Margaret Russell ?:

 

Margaret Russell seems to be the widely accepted name of the wife of John Todd, Margaret is well documented as her given name.  We have seen no verification of the surname Russell but the two look nice together so we will leave them until someone proves otherwise.

     I will to my son Hugh McClure the plantation on which I live, all farming implements, a horse and colt, and all livestock except the hogs which are for the support of my widow and two unmarried daus on condition that he support his mother comfortably during her natural life agreeable to her condition and past manner of life, and pay $10 to each of his brothers Thomas and William within two years of my decease.

     I allow my two daus Patsy and Ann to remain in my house while unmarried, and to have up to four acres of ground in my plantation to raise flax and cotton. Revolutionary Pension Application of Thomas McClure

     I was born 25 December 1764 in Pennsylvania, 18 miles from Lancaster in the County of Lancaster.

Pvt. in Company of Capt. James Taggert of Regiment commanded by Col. Davidson in the N. C. Militia for 7 mo., 22 dys. Certificate of pensioner issued 14 Feb 1833.

Pension applied for 15 Oct 1832 at Courthouse, Concord, NC.

Age of resident: 67 yrs., 25 days of Dec last.

Entered as volunteer 15 Apr 1780 in Meck. County, NC., Capt. Taggart. Col, with Lt. George McKnight, Ensign: George Graham: Major James White and Col. Davidson [afterwards Gen. who was killed on Catawba River- in this company 30 days as guard on McAlpine Creek in Mecklenburg-- about 300 men there with him.

Served this term: discharged by James Taggart middle of May 1780.

Volunteered again May 1780 in Mecklenburg a few days after the other discharge. Under same officers... for expedition against Ramsor's Mill in June 1780-- arrived about 1 hr after Battle. He [Thomas] guarded prisoners from that.

Marched from Mecklenburg towards Rocky Mount in South Carolina. He served 3 weeks as a volunteer-- discharged July 1780.

Volunteered again last of Sept 1780 for 4 weeks in Mecklenburg County near Charlotte where my father lived-- was of the mounted infantry under Col. W. A. Davis. In those 4 weeks we did much service in the vicinity of Charlotte-- discharged by Col. Davis about last of Oct 1780. Col. Davis during these 4 weeks took at one time: 15 prisoners, upwards of 300 baggage wagons from the rear of the main army under Cornwallis.

I volunteered again in month of Dec 1780 for 6 weeks [proclamation having been made that all volunteered for 6 weeks tour should receive pay for 3 months.] Capt Joseph Taggart, Lt. James Spratt: Regiment Commanded by General Francis Locke for march through Guilford and Orange [Counties] to about Hillsboro, NC, and I joined Nathaniel Greene of the Regular Army at Haw River-- we had been met before this by the cavalry under Col. Washington and Col. Lee.. Guildrod was fought. I was there in month of February after 6 weeks... Drafted and placed under Capt. Duckworth, Lt. Joseph Fasure, and Ensign Alexander Robinson... had no higher officer til joined regular Army under Green.

Marched with these to S. C., joined Green at the High Hill of Santee-- placed under Malmead, a French Officer of the Regulars. Remained there til within 10 dys of the 3 months and was sent with prisoners that had been taken at Eutaw to Salisbury where I was discharged by Capt. John Duckworth. While at High Hill of Santee I knew Major Hamilton of Regular Army. I served out these 3 months-- discharged Dec 1781.

I have lost or mislaid all my discharges. Born 25 Dec 1964 in Pennsylvania, 18 miles from Lancaster in the County of Lancaster. My family moved from there and settled in Mecklenburg County, N. C. from where I moved to that part of the same county, now called Cabarrus, in which I have now lived about 21 years... I was always a volunteer-- have no documentary evidence... of my service. for character reference refer to Rev. Dr. John Robinson, D. D. and Abraham Alexander, Esquire.

     In the name of God amen. I John Todd of the State and County aforesaid being very sick and weak in body but of perfect mind and memory thanks be given unto God calling unto mind the mortality of my body and knowing that it is appointed for all men once to die do make and ordain this my last Will and Testament [that is to say] principally and first of all I give and recommend my soul into the hands of almighty God that gave it and my body I recommend to the earth be buried in decent Christian burial at the discretion of my Executors nothing doubting but at the general resurrection I shall receive the same again by the mighty power of God, and as touching such worldly Estate where with it has pleased God to bless me within this life.

     I give desire and dispose of the same in following manner and form to wit:

First I give and bequeath to my beloved son William M. Todd one dollar.

2nd I give and bequeath one dollar to my son James Todd.

3rd I give and bequeath one dollar to my son Joseph Todd.

4th I give and bequeath one dollar to my son Adam Todd.

5th I give and bequeath one dollar to my daughter Elizabeth Todd.

6th I give and bequeath to my son John Todd fifty five acres of land lying and being in the County and State aforesaid on the dry fork of Lick Creek adjoining Robertsons, Raules and Hall. Also 1 gray filly about 2 years old.

7th I give and bequeath to my son Felix Todd 75 and 3/4 acres of land lying and being in County and State aforesaid, 50 acres of which is a part of the tract of land my son Adam Todd now lives on adjoining the tract of land that I now live on 25 3/4 acres to be run off of the northwest end of the land that I now live on adjoining Walker and Joseph Todd land.

8th I give and bequeath to my dearly beloved wife Mary Todd 75 3/4 acres of land where I now live including the buildings and plantation and sum adjoining saw mill, one yoke of oxen and cart, three mares and one filly to use for and during her natural life, but at her decease I give and bequeath the said land and oxen to my son Augustus.

I give and bequeath to my wife all my household and kitchen furniture, plantation tools also all my stock of cattle sheep and all moneys due to me in anyways whatsoever.

It is also my wish and desire that my said wife do pay each one of my 4 daughters fifty dollars apiece on their marriage---Sally Todd, Maria Todd, Matilda Todd, Polly Todd.

It is also my wish that at the decease of my said wife the said household and kitchen furniture with the stock of cattle, sheep and hogs be equally divided amongst my said daughters Sally, Maria Matilda and Polly

My just debts to be paid out of the money due to me and the personal property left in my hands.

And I do by these presents constitute make and ordain my sons Joseph Todd and Adam Todd my Executors of this my last Will and Testament and I do hereby utterly dissalow revoke and disannul all and every other former Testament, will,legacies and Executors by me in any ways before named will and bequeathed satisfying and confirming this and no other to be my last Will and Testament.

In witness whereof I have hereunto set my hand and seal this 7th Aug 1815.

Being in a sick and low condition, I will to my son Marcus Barnett 100 A adj my son Amos Barnett including the improvements made by sd Marcus, as well as a feather bed and furniture, and two cows; to my son James G. Barnett 80 A on the south side of my son Marcus Barnett, a feather bed and furniture, and a cow; to my son David Edwin Barnett 100 A on the east side of my land adj James Lindsay's old plantation, Moses Wallace, and Joseph Sample, also a feather bed and furniture, and two cows; to my son Robert Franklin Barnett the residue of my land including the old improvements where I now live, the sawmill site, the 11 A purchased from William Robison previous to buying the whole [of the Robison place] from the Richard Robison heirs, but excluding the portion of this tract hereinafter bequeathed to Amos and Hugh Moore Barnett, a feather bed and furniture, and two cows; to my son Hugh Moore Barnett the residue of the land bought from Richard Robison's heirs estimated at 130 A excluding the 11 A mentioned above; and to my son Amos Barnett 100 A including his improvements.

     7.  Hugh2 Todd (John1) was born Abt. 1742, and died Bef. October 1787 in Mecklenburg Co., NC.  He married Elizabeth Anderson ?.  She died Aft. 1787 in Mecklenburg Co., NC.

 

Notes for Hugh Todd:

John Todd, Hugh Todd, and the whole Mecklenburg Co., legal community, did posterity a great disservice. John Todd mentions the children of his deceased son Hugh in his will, but fails to provide their names. Hugh Todd was inconsiderate in not leaving us a will giving the names of his children. We have an excellent record of Hugh's estate in the court records except that apparently there is no record of who are the recipents of the six shares of his estate. We can speculate that he left a wife and five children. Someone may have the answer to this question, I do not, and for want of a better approach find it convenient to attribute the several extra Todds floating around to this family.

     That Hugh's wife was an Elizabeth is known, there are some who speculate that she may have been an Anderson, we have seen nothing to prove this either way so she will be treated as an unknown.

No. 14. This Indenture made Dec. 7. 1808 Between Robert Todd & John A. Todd. Said Robert of the State of Georgia & County of Franklin and Jno. A. Todd of Kentuckey State in Barron County of the one part And James Hunter of Mecklenburg County in North Carolina of the other part. Witnesseth that they the said Robert Todd & John Anderson Todd for the consideration of the sum of 600 Dollars to them in hand paid by the said James Hunter. the rec. whereof is hereby acknowledged. Hath given granted bargained sold aliened infeossed conveyed & confirmed unto him the said James Hunter his kin & assigns for ever a certain peice or parcel of land in said County on Long Creek. ][ I will not go through the actual description of the land included in the indenture other than to say that it does say that 266 acres were included, my purpose in including the above transcription is to show the fact that both Robert & John were indicated as being from out of state. There is no mention of John Costen in the Court records from 1789 until 1808 which makes me think that the entries after 1808 are for a John Costen son of John and Hannah. Also I can't find a listing for John in the 1790 Census, or in any tax list, all this leads me to believe that John died in late 1789 or early 1790. I futher believe that since there is no evidence of any other Costen families in Mecklenburg, that the John and James listed in court records and will witnessing are in fact sons of John and Hannah. Further as there is no widow Costen in the 1790 census I suspect that Hannah and the children are in fact living with one of the Todd families in 1790.

The follow [jury] were empanneled [viz] James Sloan, Grief W. Gray, Adam Todd, Phill. Johnston, John A. Todd, Brazil Muse, Nathan Orr, James Reed, Samuel H. Todd William Gray, Joseph McGinnis, & Joseph McDonald who find the bonds declared on to be the act & deed of the defendant the principal money of which amounts to the Sum of $5,762.67 and interest $638.43 which added together makes the sum of $6,401.10, and they further find payments to the amount of $1013.84 had been made to John G. Hoskins, plaintiff, intestate, and that the payments in all amount to $1264.91 which deducted from the principal & interest of the bonds declared on leaves a balance due the plantiff of $5,136.19 which sum is to bear interest until paid.

Summerville who after being duly Sworn according to law proceeded to lay off and allot to Jane Todd her dower and thirds in the lands of George A. Todd, decd., described in the said writ [not reproduced in the minutes] according to the following metes and bounds, Viz: Begining at a stake on the old line and runs S 32 E 24 poles to a hickory James C. Todds corner, thence with his line S 60 E 118 poles to a Mulberry tree on said line, thence N 73 E 32 poles to a small Black Oak by a fence, thence N 15 E 36 poles to a post oak in the creek, thence N 30 W 32 poles to a small red oak by a drain, thence W 128 poles to the begining containing 40[?] acres including the dwelling house that said deceased was accustomed most generally next before his death to dwell [in] commonly called the mansion house, together with the out houses thereunto belonging or appertaining and preceeded to put in possession of the same. Book 8, p. 196. Nov Session 1835. Wm. R. Lindsey, admr. of John G. Hoskins, decd., vs Joshua A. Dinkins. Pleas- Gen. Issue, payment & sett off. The follow [jury] were empanneled [viz] James Sloan, Grief W. Gray, Adam Todd, Phill. Johnston, John A. Todd, Brazil Muse, Nathan Orr, James Reed, Samuel H. Todd, William Gray, Joseph McGinnis, & Joseph McDonald who find the bonds declared on to be the act & deed of the defendant the principal money of which amounts to the Sum of $5,762.67 and interest $638.43 which added together makes the sum of $6,401.10, and they further find payments to the amount of $1013.84 had been made to John G. Hoskins, plaintiff, intestate, and that the payments in all amount to $1264.91 which deducted from the principal & interest of the bonds declared on leaves a balance due the plantiff of $5,136.19 which sum is to bear interest until paid.

Obit: From The Mecklenburg Times in early 1890 was found an article entitled " Deaths in Paw Creek During 1889" 'During the year 1889 we have buried in Paw Creek grave yard more aged persons than usual in the same period of time.

      The fourth in order is Mrs. Caroline Todd, who died November 25, 1889, in the 73rd year of her age. She was the widow of Samuel Harvey Todd and a member of Paw Creek church. She was a mild, quiet and conceding temperament, and was by grace sustained and strengthened as a christian in her last affliction and death.
