TF 20: The Todd Family of Lancaster County PA and Rowan/Iredell Co NC

Researched and Compiled by the Rev David Todd and Glenda F. Dobbs, the latter of which is  based mostly on Norma Todd Cansler’s work supplemented by later research by Gwen Dalseg, Daymon Gilliland, Richard McMurtry. Revised 23 April 2016

 

Prior to 1742 a family of Todds came to the Pennsylvania frontier settling in Hanover Township in Lancaster County (the portion that later became Dauphin County).    By 1750, Samuel Todd was a resident in the western part of Hanover Township and James Todd b 1712 was a resident in the eastern part of Hanover Township.   Samuel Todd came to Rowan Co between 1750 and 1758 when he died and his estate was administered by Nathan Todd assumed to be his son.  Nathan settled on Little Dutchman’s Creek.   John Todd was in Rowan Co by 1755 and secured a grant for 522 acres on Grant’s Creek in 1759.  These two Todd family branches are unrelated to the Todd family that came from Northampton Co PA and settled in the Jersey Settlement several miles to the NW of the Grant’s Creek Todds.    Later historians have often conflated the various members of these two unrelated families into one family because of similarities in the first names.

 

We aren’t sure of the exact relationships between the Grant’s Creek and Dutchman’s Creek Todds but they are all close kin based on DNA genetic analysis of descendants of the James b 1712, John b 1724, Nathan b 1727-1734  branches of the family.    Samuel Todd d 1759 is therefore assumed to have been the father to Nathan, James, and John and possibly to the Thomas Todd who appears in the 1755 and 1759 tax lists and then disappears or there could be a different relationship between them all. 

 

The family history of the Hanover Township Todds was compiled by Rev David Todd, a descendant of James Todd 1712-1798 and sent to William H Egle, Archivist for the state of Pennsylvania.  In 1896, Dr. Egle published the account but added some of his own research in the Lancaster County archives, erroneously concluding based on an index entry, that the Hugh Todd who died in Lancaster County in 1772 was the father of the Hanover Township Todds and that the administrator of his estate, Jeannette Todd, was the mother of these Todds.  However, the actual will revealed that Hugh Todd was a single man, son of James Todd d 1781 and Jeannette Todd, of Chester County and no relation to the Todds of Hanover Township.   Dr. Egle’s account also stated that “ A brother John also came to Pennsylvania but his family went to the southward probably about 1750.” And elsewhere he states that James Todd 1712-1798 had a “brother Cornelius who married and removed to North Carolina” and a “brother Hugh who married and removed to North Carolina”.

 

What we have discovered is that Samuel Todd d 1758, John Todd b 1724 and Nathan Todd born prior to 1737 all went to Rowan County North Carolina and that descendants of John b 1724 and Nathan born pr to 1737 and James b 1712 all have the same DNA.   The movements reported by Dr. Egle appear to be a confusion of the actual movements, but the notion of a movement southward and a movement to North Carolina have been confirmed by our male DNA testing.

1755 and 1759 tax lists for Rowan Co and Nathan Todd is the admininstrator of the estate for Samuel Todd in Rowan Co in 1759.

            James is the only one of the family to have remained in Lancaster Co after Samuel and the

other children migrated to Rowan Co NC.

with in the 1820 census with young boys and girls and with 2 males born 1795-1804.

The fate of both sets of children is unknown.

John appears in the 1800 census with a dau 1790-1800, then his widow Jane appears in the 1810 census with a daughter 1795-1800.  This all fits.

Samuel Todd b 1780s d 1842 Marion Co IN

Samuel Todd appears as an unmarried man in the 1810 census with an older man living with him, but not in subsequent censuses.   The DNA of a Samuel Todd b 1780-1790 who appears in Indiana by about 1815 matches the Dutchman’s Creek Todds; so this Indiana Samuel is considered to be the Samuel of the 1820 Iredell Co Census.

Thomas Todd (appears in the 1755 tax list so would be of the same generation as the first

generation Todds to arrive in the County.  

There is a Thomas Todd and a John Todd in the 1770 tax list identified as a son but not son of whom , but there is a John Todd with 4 taxables which would suggest that the Thomas is a previously unidentified son of John)

This appears to be another Thomas and even harder to place because of his marriage in 1771 to Jean Simonton who was from the part of Rowan Co that became Iredell County.   It is hard to place Thomas who married Jean Simonton, but it has been assumed that he is of the Dutchman’s Creek area because that is where the Simonton, Allisons, and related families lived.

Below is a narrative that provides more detail about the family of Todds who settled in Grant’s Creek and following that is a family skeleton of the family of the Dutchman Creek Todds.  And the end is the family descendants of Samuel Todd 1780s-1842.

 

I wonder if the Thomas Todd b 1793 might be the Thomas Todd md 1825 to Elizabeth Blackwell.  He isn’t in the 1830 or 1840 census, but when he appears in the 1850 census he is living alone but owns many slaves.

Todds of Grant’s Creek

John Sharp Sr. Todd (1.John1) b. 11-Dec-1724, m. ca 1754, Nancy Unknown, b. 07-Jun-1739.5 John died 1798, Rowan County, NC.

22-Feb-1759, Deed BK 4/156, Earl Granville let John Todd, a planter of Rowan County, NC have 522 acres on both sides of Todd's Branch waters of Grants Creek near Mr. Parker's mill for 10 shillings. Witnessed by George Disbowr (Disbrour) and W. Churton on 27-May-1759. On 15-Jan-1760, John Todd was appointed Constable in the room of Robert Hardin. Jno Todd was also on the 1759 Tax List as Constable. His will, 03-Feb-1798, probated 03-Feb-1800, Will BK E/47 named children; James, who died 1814 in Rowan County; Mary, and John (John was deceased), grandchildren; John, James, and Thomas, sons of deceased John and his wife Ann, and a niece, Polly Short. John Todd, Sr. on Tax List of 1784 and 1790 Salisbury District of Rowan County, NC Census, 1M o 16 and one Free White Female.

From Gwen Dalseg: Excerpts of Last Will and Testament of John Sharp Todd, Sr., 03-Feb-1798, Rowan County, NC. To my daughter, Mary Todd, fifty acres of tract whereon I now live (Grants Creek), beginning at the meadow at the dividing line between my son, James Todd, (James had already received land from his father on Grants Creek before his will) and myself; to my three grandsons, John, James, and Thomas Todd, sons of John Todd, deceased, to them and their heirs forever, the whole of the remainder of the tract of land whereon I now live (Grants Creek) after the aforesaid fifty acres of land given to my daughter, Mary, is deducted, to be equally divided between the above named John, James, and Thomas Todd, subject nevertheless to the use and occupation of their mother, Ann Todd, during her life or widowhood; to my niece, Polly Short, but it shall be at the election of my daughter, Mary, to choose which of the beds the said Polly shall receive. Executors, John Locke and John Howard.

9. iii Mary Todd b. ca 1761. Mary's father left her fifty acres of land in his will, from the tract on which he lived, next to his son, James. This was part of the Grants Creek land.

John Sharp Jr. Todd (2.John2, 1.John1) b. ca 1755,6 m. ca 1782, in Rowan County, NC, Ann Brandon, d. 17-Oct-1821, Rowan County, NC, Bur. Thyatira Presbyterian Ch (Rowan), NC. John died 30-Apr-1796, Rowan County, NC.6

From Gwen Dalseg: Excerpts of the Last Will and Testament of John Todd, Jr., Rowan County, NC 30-Apr-1796. To sell and dispose of two tracts of land, known by the name of McClaine's Place, granted to me by patent bearing date of 25-Oct-1786, containing two hundred and thirteen acres, and the other tract, lying and joining the lines of Dr. Anthony Newnon, Matthew Locke, and Martin Phifer, suppose to contain forty eight acres. Unto my wife, Ann Todd, one Negro girl by the name of Dinah, and one Negro fellow by the name of Peter, during her natural life, and at the death of my wife, to be sold and the money arising from the sale thereof, to be equally divided among my children. That is to say, Nancy, John, Elizabeth, Mary, and Thomas, and the child with which she is now pregnant. To my stepson, David Rutherford; unto my son, John, and to my wife, Ann Todd, the whole of the plantation whereon I now live, during her natural life, to be tended and cultivated for the support of my children, and after her death to be equally divided among my children. Lastly, I constitute and appoint my brother, James Todd, and John Howard to be executors. His will date 30-Apr-1796 and proved 05-May-1796, by John Locke, BK E.

Norma Todd Cansler writes on 05-Oct-2000: "On the mention of Ann Brandon, I can add a little bit of background on her. She was married four times; Brandon, Buthford or Rutherford, Todd, and Thompson, and was already a widow by 1755."

Elizabeth Brandon, in her will dated 04-Sep-1797, named a daughter, Ann Todd, BK G/154, and deeds later identify her as Ann Thompson. John's will named a stepson, David Rutherford, who was dead by 1814, BK 23/380, b ca 1760. Ann Thompson died 17-Oct-1821 in her 61st year and is buried at Thyatira Churchyard, at Mill Bridge on Cathey's Creek in Rowan County and her tombstone states it was erected by her lone son, Thomas Todd. Thyatira Presbyterian Church is located on Highway 150 in the Millbridge community about 10 miles west of Salisbury. Mary (?) and John Todd, Jr. on 1784 and 1790 Rowan County, NC Tax List. (This must be a different John unless the wife's name is Mary Ann?). John Todd, Jr. on 1790 Rowan County, NC Census, Salisbury District, with 1M o 16, 2M u 16, and 4 Free White Females.

There is a John Todd listed in the SQS Enterprises' Early NC Marriages to Ann Brandon; however, there is no date and out beside her name is 1782/5, 1789/92. SQS Enterprises' Early NC Marriages has Agnes Todd to Joseph Tomson on 06-Aug-1805 and this could be Ann. A Rowan County deed concerning Anne Thompson, BK 25/252, on 27-Apr-1819, Anne Thompson has a State Grant #3120 for 200 acres on Withrow's Creek next to John Swan, William Davenport, Jonathan Barber, and William Thompson. Had been entered on 21-May-1818.

From Rowan County Deed BK 30/1024, Thomas Todd of Rowan County, NC (no wife signs), lets John B. Todd (John Brandon Todd, his brother) have his right to 1/5 of 200 acres which belonged to his deceased mother, Ann Thompson, witnessed by Aquilla Davenport and John D. Swann, and proved by the latter in May 1830. This land is located on water of Withrow Creek and Third Creek next to John Swan, William Davenport, and Jonathan Barber, and may be located by grant from State of North Carolina to Ann Thompson bearing date 27-Apr-1819.

From Rowan County Deed BK 30/1028, John B. Todd, (John Brandon Todd)(no wife signs), lets Thomas Todd (his brother) (both of Rowan County, NC) have his right in 196 ¼ acres, which came from his deceased grandfather, John Todd, late of Rowan County, NC. Also, his right in the same tract, which came to him from his deceased brother, James Todd, by inheritance. Also, the land bought from his sisters, which is on Grants Creek. Next the dower lot of Elizabeth Todd, James Thomas, and Mary Todd, on 12-Apr-1830, witnessed by Aquilla Davenport and John D. Swann, and proved by the latter May 1830.

From Minutes of the Court of Pleas and Quarter Sessions of Rowan County 23-Oct-1755 - Ordered by the court that a citation to be executors of William Brandon be issued and next session to approve the will. Jan 1756 - Ordered that Ann Brandon, widow of William Brandon, have letters of administration of her husband's estate with the will annexed, she producing for her security, George Cathey, Sr. and Robert Reed, in the sum of 500 pounds lawful money of Great Britain. 22-Feb-1756 - Ann Brandon came into court and took oath as an administrator of the Last Will and Testament of William Brandon, deceased. In 1761 - The estate of Wm. Brandon, deceased, to Ann Brandon (now Ann Buthford), Admn. To be divided equally in three parts, viz., to Ann, the widow of the deceased, and James and John the sons, which said sum now remains in the hands of the said Ann Buthford, and the two thirds of Ann's belongings to James and John to be accounted for by Ann thereafter. 1767 - Ordered that Ann Buthford have letters of administration of all and singular (?) the estate of Thomas Buthford, deceased, John Brandon and John Frohock qualified according to law.

From all the information on Ann Brandon, we have three theories: 1/The Ann Brandon, who married John Todd, was born in 1760 (record says she died 17-Oct-1821 in her 61st year and is buried at Thyatira Churchyard). She was the daughter of Elizabeth Brandon, who made her will in 1797 and named Ann Todd as her daughter. She had a child named David Rutherford. One researcher says there is documentation that proves Ann Brandon had an affair with James Rutherford, which resulted in the birth of David Rutherford. Because both families had money, they were able to keep his name off or out of the Bastardry Bonds Book. In this case, Ann Brandon would have m/1 John Todd and m/2 Thompson. 2/The Minutes of the Court above refers to this Ann Brandon and "died in her 61st year" is incorrect and should be more like "died in her 85th year." If a widow by 1755, would place her birth year ca 1736, if she were at least 21 years of age at marriage, and making her about twenty years older than John Todd. This happened, but makes it questionable. In this case she would have m/1 Brandon, m/2 Buthford/Rutherford, m/3 Todd, and m/4 Thompson. 3/The Minutes of the Court above refers to an earlier Ann Brandon and the name Buthford and Rutherford are two different surnames.

Ann: Church record states, "Ann Thompson d. 10-17-1821, 61y. This marble was erected at the expense of Ths. Todd, alone, son of sd. Decd. as a token of gratitude from a child to a parent." Rowan Marriages 1753-1868 has John Todd and Ann Brandon (no date, during admn. of Gov. Martin 1782/5, 1789/92), Obadiah Doty, Bondsman.

10. i Nancy J. Todd b. ca 1785, m. (1) John Trott, d. 1838, Rowan County, NC, m. (2) 11-Jan-1841,6 Unknown Thomason/Thomison. Nancy died 1858/69.8 Named in her father's will.

From Gwen Dalseg: "Abstracts of Deeds of Rowan County, NC 1753-1785, Deed BK 24/583, 1816; John Trott and wife, Nancy, and Thomas H. Dent to John B. Todd and Thomas Todd for $92, three tracts: 1/34 acres on Grants Creek adjoining Lot #3, this grantor, Sam Kerr; Lot #2 Henry Trott, and Lot #1, which was part of the property devised by John Todd, deceased, to his grandson, James Todd, deceased, and divided by court order. 2/Their undivided interest in 26 acres in the estate of John Todd, Jr., deceased. 3/Their undivided interest in 6 acres left out by the surveyor in dividing the 34 acres devised by John Todd, Sr. to the heirs of John Todd, Jr., deceased, which was adjoining Mrs. Kelly and Spruce McKays' heirs. John Trott held 2/3rds of the described land by deed from Henry Trott and wife, Elizabeth, and from Sam Kerr and wife, Polly, dated 12-Jan-1816, as recorded in Rutherford County, TN. Wit: Josiah Dent and Thomas Todd. Proved by Thomas Todd and by John Monroe, who certified that Nancy Todd freely signed this deed. Proved at Feb Court 1818."

John Trott and Nancy J. Todd could have daughter, Ann Trott, who married William Thomason on 11-Jan-1841 in Rowan County, NC, and could be the niece (great niece) that was mentioned in the will of Mary Todd in 1845. Mary Todd would be Mary Erwin Todd, who married James Todd, Sr.

11. ii John Brandon Todd b. 06-Dec-1786,8 m. 13-Feb-1823, in Rowan County, NC,8 Sarah Dent, b. 19-Sep-1799,8 d. 18-Oct-1865.8 John died 20-Jun-1869. "Had three unmarried daus. 1/Martha Ann Todd b. 26-Nov-1830, 2/Mary Elizabeth Todd b. 18-Aug-1833, d. 19-Jun-1889, and 3/Mariah Catherine Todd b. 21-Aug-1836," per Norma Todd Cansler. Also, this John B. Todd may be the father of the John T. Todd who married Dorothy C. Reese on 07-Sep-1853 in Rowan County, NC. Abel Cowan, Bondsman, and Hy. Giles, Wit. Named in his father's will. John inherited land from his grandfather on Grants Creek.

12. iii Elizabeth P. Todd b. Aug 1788,8 m. 12-Nov-1811, in Rowan County, NC, Henry Trott. Lived in Texas 1869. Named in her father's will.

13. iv Mary "Polly" Todd b. ca 1789, m. 01-Apr-1812, in Rowan County, NC,8 Samuel Kerr. Moved to Rutherford County, TN and in 1869, lived in Memphis, TN. Named in her father's will.

14. v Thomas Todd b. 06-Sep-1793, d. 23-Jul-1869, Rowan County, NC, Bur. Thyatira Cemetery (Rowan), NC. This Presbyterian "mother church" of the Yadkin River basin was formed from Cathy's Meetinghouse established by some of the earliest settlers. Was named in his father's will. On 05-Nov-1805 John Todd of lawful age chose as guardian, Matt Howard; Security, John Howard. James Todd chose as guardian, James Todd; Security, John Howard, and Thomas Todd chose John Howard; Security, James Todd. He was single and left a will leaving his money to his free slaves. Thomas inherited land from his grandfather on Grants Creek.

15. vi James Todd b. ca 1796, d. 1818. Born after father's will was prepared. Will stated "and child of pregnancy." He died intestate in 1818 and land was divided among five brothers and sisters, BK 24/583 and BK A/123 of Division of Estates. James inherited land from his grandfather on Grants Creek.

(2) aft 1806, Mary "Polly" Erwin, (daughter of Joseph Sr. Erwin and Agness Reed) d. 1846. James died 17-Nov-1814, Rowan County, NC.5

A James Todd was on the USGenWeb Archives Muster Rolls, Soldiers of War of 1812 Detached from Militia of North Carolina 1812-1814 by William R. Navey. Had James Todd, Riflemen, 6th Company, and detached from 11th Brigade. I believe it is this James Todd. James is on the 1790 Salisbury District of Rowan County, NC Census, 1M o 16, 2M u 16, and 2 Free White Females. Will BK G/336, his widow, Mary, sold her life interest in his estate in 1831, and BK 31/213. (This would be Grants Creek land, where he was living next to his father, John Sharp Todd, Sr.).

From Gwen Dalseg: 1778 and 1779, Guard at Salisbury District Gaol, Sep 9, Captain William Wilson's Company, James Todd. It could be this James Todd and also listed in the Roster of Rev Soldiers NC, Watauga County, and Kings Mountain.

From Gwen Dalseg: Excerpts from the Last Will and Testament of James Todd 17-May-1814. Unto my loving wife, Mary Todd, fifty acres. (This makes me wonder if James was married to both Mary Erwin and Margaret Erwin, sisters. Margaret could have deceased and then he married Mary)? Unto my son, John S. Todd, fifty acres, land joining Thomas Todd, Sr.; unto my son, Joseph E. Todd, fifty acres of land joining my son, John S. Todd; unto my son, James Todd, fifty acres of land joining along Joseph E. Todd; unto my son, William Todd, fifty acres of land joining along James Todd; unto my daughter, Polly Todd, and to Henry Allemong, if any coming to him of my personal estate after he settle up with my estate. Executors, John Locke and Thomas Todd. Note: We are still talking about Grants Creek land here.

P/112 5:227, 08-May-1789, Overseers of the Roads apptd., James Todd from Thos. Frohock's Mill to James Dobbins Ford on 2nd Creek with the following hands: Thomas Frohock, Dr. Newnan, Andrew Christy, Peter Pinxton, Jacob Link, Richd. Geo., Hugh and Henry Robison, John and Hugh Dobbins, Edward Howard, Thomas Green, and Ralph Hinds. P/7, 18-Apr-1807, Wit: James Todd, land divided between Squire Thompson (#1 lot, 101 acres) and Henry Robison (#2 lot, 86 acres). (I believe the above three records refer to this James Todd because of the dates and names. James Todd, Sr.'s son, Joseph Erwin Todd, married Margaret Robinson, probably related to Hugh and Henry Robinson. James Todd Sr.'s wife (wives), Margaret Erwin and possibly Mary Erwin, had two sisters that married Dobbins).

P/24 #425 P/421, 10-Mar-1814, Henry Allemong to Ezra Allemong for ten pounds sterling, 48 acres adjoining Gasper (?), Perkins, Miller, and Younts. Wit: Wm. H. Brandon and James Todd. Acknowledged at Nov Court 1814. Note: Henry Allemong was James Todd, Sr.'s son-in-law, married to daughter, Nancy. James Todd, Sr. is then deceased 17-Nov-1814.

P/29 #500 P/496, 10-Feb-1816, John S. Todd to Thomas Todd for 54.10 pounds sterling for 50 acres on Grant's Creek adjoining Thomas Todd, Sr. It was devised by James Todd, deceased, to his son, this grantor. Wit: Joseph Graham and Wm. Heanley. Proved by Graham at Feb Court 1816. Note: John S. Todd is John Sharp Todd, son of James Todd, Sr. and Margaret Erwin. Thomas Todd is the son of John Sharp Todd, Jr. and John S. and Thomas would be first cousins. Not sure about Thomas Todd, Sr.?

From Gwen Dalseg May 30, 2004: "I have a couple of things for you to ponder concerning my James Todd. I was looking through my data on him and looked at the disbursement of Agness Reed Erwin's estate of 1806. The paper said that she was deceased by 1803, seven years after her husband Joseph. What struck me as interesting was that James Todd is listed as receiving certain items: 'to one bed part', to one bay horse', 'to one book', 'to one sieve' and Margret Todd is listed as receiving "to one bed and furniture". Not too surprising, as they are a married couple. So the information that I have from the History of Watauga County by J.P. Arthur, referring to the marriage of James Todd and Margret Erwin, should be looked at to be mostly accurate. Also that the marriage date should be correct, Mar 11, 1784 although I haven't found the actual document yet.

"Now we come to Mary (Polly) Erwin. In her father's will (Joseph), she is referred to as Mary and in her mother's will as Mary, but in her mother's estate, as Polly. What I take from this data is:

1) "James did marry Margret first. 2) They were still married as of 1806. 3) That Margret died sometime between 1806 and Nov 1814 when James died. 4) That James could have married Mary (Polly) Erwin after Margret died (rather quickly if true!) 5) That is the reason why Mary is listed as his 'loving wife' in his will.

"Also, in looking at your wonderful book, I can find no other James Todd that could be confused as far as mistaking him for another James Todd. My James Todd is found living next door to his widowed sister-in-law, Ann Brandon Todd in the 1800 Federal Census. Along with them are a lot of Thomasons and Thompsons. I wonder if they are the same family but the spelling is messed up?"

From Gwen Dalseg: Excerpts from the Last Will and Testament of Joseph Erwin, father of Margaret Erwin, Rowan County, NC 20-Jun-1793. To my wife, Agness, land on the north side, to my daughter, Mary, and in case Mary behaves virtuously, I allow her my Negro wench, Luce, after my wife's death. In case the wench, Luce, should have children before that time, I allow them to be sold and divided amongst all my children, but in case my daughter, Mary, shall displease and disobey by beloved wife, the wench, Luce, and the fellow, Sharp, shall be both sold after my wife's death and divided amongst all my children. To my son, William; to my daughter, Grissel; to my daughter, Agness; to my daughter, Peggy (Margaret); and to my son, Joseph. Lastly, I do nominate, constitute, and appoint my two sons, William and Joseph Erwin to be executors.

From Gwen Dalseg: Excerpts from the Last Will and Testament of Agness Reed Erwin, the mother of Margaret Erwin 03-Aug-1803, Rowan County, NC. Item, unto to my loving daughter, Isabel Johnston, my black velvet mantel. Item, unto my loving daughter, Nancy Dobbins; Item, unto my loving daughter, Mary Erwin; unto my loving sons, William and Joseph Erwin; unto my granddaughter, Nancy Walker; unto to my loving daughter, Greacey Dobbins; I give and bequeath to my daughter by law, Ceaty; unto my loving daughter, Margaret Todd, one dark brown heifer about two years old. I give and bequeath to my loving five daughters, Isabel, Greasy, Nancy, Margaret, and Mary, all the residue of my estate. Lastly, I do nominate, constitute, and appoint Mary Erwin and Joseph Kerr, executors of this my last will. Note: this proves Margaret was alive in 1803.

From Gwen Dalseg: Inventory of Account of Sale for Agness Erwin, 1803. Be it known that Thomas Rowan and Hugh (?) Braly, Esquires and Justices of the Peace for the said County of Rowan aforesaid, have examined and settled the account of Joseph Kerr and Mary Erwin, executors of the Estate of Agness Erwin, deceased, etc. James Todd, Margaret Todd, and Polly (Mary) Erwin were listed on the Nov 6, 1803 Settlement of the Estate. Again, this proves that Margaret is still alive in 1803 and James and Mary (Margaret's sister) would have married between 1803 and 1814, when James died. Also listed were Joseph Erwin, William Erwin, Grizel Dobbins, Joshua Lawrance, Joseph Kerr, Alexander Dobbins, and Hugh Dobbins, among several others.

Mary: Named in her father and mother's will. I am placing Mary Erwin as second wife of James Todd because his will named his wife as Mary, and his wife, Margaret Erwin, had a sister named Mary Erwin. This is only by circumstantial evidence. There is a Last Will and Testament of Mary Todd in Rowan County, NC on Feb 1846 that I believe is this Mary Todd who probably married James Todd.

From Gwen Dalseg: I, Mary Todd, of said State and County, single woman, being of sound and disposing mind and memory, and in good bodily health for my years, do make and ordain the following to be my Last Will and Testament, revoking all other wills or testaments. Item 1st I will and bequeath to William B. Lowry, son of my dear friends, Richard and Elizabeth Lowry, one bed and bedstead consisting of one feather bed, under bed, mattress, a pair of sheets, a calico bed quilt and dimity (?). Item 2nd I will and bequeath to my dear niece, Ann Thomison, wife of William Thomison, (this would probably be the child of one of Mary Erwin's siblings) all my wearing apparel of all kinds, and the balance or remainder of all my bedclothes, without reserve. Item 3rd I will and bequeath to my very dear friend, Richard Lowry, of the State and County, all my personal profit of every kind, not heretofore mentioned in this instrument of writing, in consequence of his brotherly like kindness towards me in affording me a comfortable home and a happy residence in my last days, and in consequence also of the kindness, attention, and consolation of his amicable wife when I most stood in need of them. Item 4th I hereby appoint and constitute my dear friend, Richard Lowry, aforesaid, my sole and only executor of this my Last Will and Testament. In witness whereof I have hereunto set my name and affixed my seal this 12th day of May in the year of our Lord 1845. Signed and sealed in presence of Isaac Burns, Jr. and Conry Macay.

Previous dates from Norma Todd Cansler came from military records when the wife filed for benefits and got the dates wrong.

17. ii Nancy Todd b. ca 1786, m. 25-Apr-1811, in Rowan County, NC,8 Henry Allemong. Husband, Henry Allemong, was named in her father's will. They sold her inheritance in 1821, BK 26 /293. (Grant Creeks land).

From Gwen Dalseg: Abstracts of Deeds of Rowan County, NC 1753-1785: 3524. P/621, 14-Apr-1818 Bill of Sale: Mary Todd, widow, to Joseph E. Todd for $375, a Negro boy named Andrew about 13 years old. This grantor was to have use of this boy during her lifetime, provided he was not moved out of Rowan County without the consent of this grantee. Joseph E. Todd also signed. Wit: Roberts Nanny. Proved by Nanny at May Court 1818. Note: I am not sure which Mary Todd this could be. It could be Mary Erwin, who probably married James Todd, making her the stepmother and aunt of Joseph E. Todd. The will of Agness Reed Erwin on 03-Aug-1893 says, "and agreeable to my husband's will, I give to my daughter, Mary Erwin, the wench Luce at my death." The will of Joseph Erwin on 20-Jun-1793 says, "and in case my daughter, Mary, behaves virtuously, I allow her my Negro wench Luce after my wife's death. In case the wench Luce should have children before that time, I allow them to be sold and divided amongst all my children." By 1818, the wench Luce could have had Andrew, who would be about 13 years old. Margaret Erwin was Joseph Erwin Todd's mother. She had a sister named Mary Erwin, who I believe was the second wife of James because his will names his wife as Mary and not Margaret.

Gwen Dalseg says Joseph Erwin Todd died without a will and apparently owed more money than he had property. Margaret: Another possible daughter is Mary E. Todd who m. Francis A. James.

From the old Todd family Bible printed in Edinborough by Mark and Charles Kerr, MDCCXCI, it is learned that James Todd was born Jul 31, 1757 and Margaret Erwin, his wife, Oct 14, 1759. These were married Mar 11, 1784, and his wife, Nancy, was born Jun 7, 1739. James died Nov 17, 1814. He was a soldier of the Revolution, and Mrs. Lizzie McGhee of Boone, has the old powder horn he used in that war.

(Gwen's Notes: Colonel Joe B. Todd must have come into possession of the old Bible through his father Joseph Erwin Todd. Mrs. Lizzie McGhee is Mary Elizabeth Todd d/o James Todd, Jr. and Jane Ray).

"Colonel Joe B. Todd's first wife was Caroline McGhee, a daughter of the first Jordan Councill, and wife of William McGhee, who was born Dec 5, 1830 and died Sep 1, 1873. Two of their children are buried in the cemetery at Boone. Joe C. Todd, born Nov 8, 1855 and died Nov 1, 1858, and Maggie E., born Jul 7, 1853 and died Feb 12, 1858. James Polk Todd and Mary, wife of F. P. Moore, and William G. Todd, three of his children survive him.

"Colonel Todd's second wife was Mrs. Eliza Edmisten, widow of Harrison Edmisten and a daughter of Mr. Dancy of Wilkes County. (Gwen's Note: Nancy Eliza Dancy's parents were J. R. Dancy and Fanny?).

"Colonel Todd was a non-commissioned officer in the Mexican War, having first volunteered in Boone, but there being a delay in calling out the volunteers from Ashe County, he went to Cabarrass County, joined a company there and went to Mexico with them, participating in several battles. He received a pension till the Civil War, and it was restored long after the close of that struggle. He was a colonel of the 98th North Carolina Militia.

"He was a candidate for clerk of the Superior Court in Aug 1852, but was defeated by George M. Bingham, who however, resigned, owing to an impediment in his speech, and a young lawyer named Clewell was appointed in his place. Upon Clewell's removal from Watauga, Colonel Joe B. Todd was appointed by the court, and he was sent for in the night, his residence then being at Dugger, now Penly Post Office, east of the Blue Ridge. He was First Lieutenant in CO D 1st NC CAV in the Civil War, but resigned on account of heart disease and returned home. He re-entered the service soon; however, joining the 37th CAV INF. After the close of the war, he was elected clerk of the Superior Court and served till the arrival of Judge J. L. Henry, when he was removed because he could not take the iron-clad oath. He was elected to the legislature in 1872, and then in 1882, to the office clerk of the Superior Court, which office he held for twelve years after the close of the Civil War. This makes the longest service of anyone in this office in Watauga County. Colonel Todd was highly esteemed by all. He was a fine sportsman, delighting in hunting and fishing."

He was born September 2, 1822, and died December 11, 1903. These were married March 11, 1784; and that John Sharp Todd, father of James, was born December 11, 1724, and his wife Nancy, was born June 7, 1739. James Todd died November 17, 1814. He was a soldier of the Revolution and Mrs. Lizzie McGhee, of Boone, has the old powder horn he used in that war.

His grandfather, James Todd, was born on the trip from the old world on July 31, 1757. James Todd married to Margaret Erwin on March 11, 1784, after serving as a captain in the Continental Army."

*This is in reference to Joseph Warren Todd who grew up in Ashe County.

Obituary for Joseph Beckeweth Todd from the Watauga Democrat on December 17, 1903:

"Col. J. B. Todd Dead"

"Joseph Beckeweth Todd was born in Rowan County, N. C., September 2nd, 1822. Died at Boone, Watauga Co., N. C. December 11, 1903, aged 81 years three months and nine days. He came to the mountains 60 years ago. He belonged to company C. U. S. Vol. in the war with Mexico. The company was formed in January 1847, at Charlotte N. D. was called into service January 22, 1847. Was second sergeant in said company. Was mustered out at Smithfield N. C. August 7th 1848. He was also elected officer in company "D" first N. C. Calvary. Was Lieutenant in said company in the Confederate army.

The above dates cover a great part of the life of J. B. Todd. After the civil war he located at Boone, and filled many positions of trust. His first wife died some 30 years ago, his last wife and three children survive him. Joe Todd was no ordinary man. He was universally loved. Like Ben Ahdem, of legendary fame, who besought the angel writing in the book of gold to tell him what he was writing by the pale beams of the moonlight. This was the secret with our aged friend, who on last Saturday morning answered the roll call from spirit voices and who steered his barge for ports eternal. He had a great and generous heart and never failed to respond to the calls of the needy. The clarity, which suffereth long and is kind, was his. Many will hear of his departure will feel the tears start as they remember deeds of kindness done for them by this kink old friend who had found how much sweeter it is to give than to receive. His familiar form, his kind voice will be missed in our midst but his memory will ever be green in the hearts of the hosts of friends and relatives he leaves behind. He was buried with Masonic honors. Rev. Sherwood conducted religious services at the Methodist church from whence his body was interred in the cemetery at Boone, to await the resurrection morn whence he shall rise again. O! wondrous thought before the judgement day. Our sympathy is extended to his bereaved family in this their affliction."

"J. Polk Todd Dies at Lancaster, Wash."

"J. Polk Todd, brother of Mr. W. G. Todd of Boone, and well remembered by the older residents of this section, died at home in Lancaster, Washington, February 22. Mr. Todd's illness with heart trouble and complications was brief, but it is stated that his general health had been poor for a long time. He was 77 years old.

Funeral services were conducted in Lancaster on the 24th and burial was in that town, however, relatives here have not been apprised of the funeral details.

Mr. Todd was a son of the late Col. J. B. Todd and was born in Boone. He located in the state of Washington in 1903 and had been back to Watauga County only twice since that time. He visited here briefly in 1910 and in 1935. Mr. Todd engaged in farming here as a young man, and was educated at Globe Academy and remained a member of the Globe Baptist Church throughout his adult life. IN his adopted state, he was engaged in the operation of grain warehouses, buying large quantities of wheat, and was successful. He was a citizen of the most substantial kind, and had large numbers of friends both in this area and in the state of Washington.

Mr. Todd was first married to Miss Hattie Shull of Burke County, and two daughters by this marriage survive: Mrs. J. Roby Hayes, Charlottesville, VA., and Mrs. Mary Jones who lives in the state of Washington. The widow, who survives was the former Miss Mary Moore of Mulberry, and their three children survive: Joe, Ruby, and Jim Moore Todd, all residents of the state of Washington.

One brother, Mr. W. G. Todd of Boone survives. Another sister, Mrs. Finley Moore of Globe, died a year ago."

James Polk Todd died in 1940 and is buried in St. John Cemetery, St. John, Whitman County, Washington. He is buried with his second wife Mary Caroline Moore Todd in the oldest section at the top of the hill in the cemetery. Mary Caroline Moore Todd died March 24, 1947. Approximately 20' below in a direct line is where Ruby R. Todd Kinder Jones is buried with her two husbands. Joe W. Todd might be buried in California, according to the obituary of his father and James Moore Todd is most likely buried somewhere in Seattle or Bremerton, Washington.
