John Todd's will lists him as of Southampton, a widower with children

There is an Elizabeth Mallory, child of Horatio (and probably Dorothy-

married 8/29/1629 Southampton) baptised
Southampton 10/9/1642. Horatio's

Elizabeth Mallory married William Rivers 3/12/1662, no will or burial
listed
for him."

In the will of Elizabeth Cuttrie (see below),
written in 1656 in Bermuda, she
elects her daughter Elizabeth Todd as executrix, and provides for her
daughter's children. Four years earlier she obtained a very fair divorce
from Mr. Cuttrie, of the sort usually seen
when the widowed marry and later
divorce, so I don't believe Cuttrie was
Elizabeth Todd's maiden name.
I've contacted the owner of the most comprehensive online Tatum website.
They have Elizabeth as a Mallory, not a Paynter,
and I think I agree with
them. Stephen Paynter names his daughters as
just that, and later even
names his grandchildren, but Elizabeth Todd's brief mention is only as
John
Todd's wife and her children are not mentioned at all.
The Tatum researcher tells me that the info is referenced in a booklet
called
the Tatum Narrative which focuses on a couple of brothers who migrated
into
the New York, New Jersey Area. It is on page 27 of the Tatum Narrative.
The
reference closest to it and the only one that could apply says "Port Royal
Records". The reference is next to the first line of three short
paragraphs
and it is not clear if it applies to the first paragraph only, or all
three.
The total of the paragraphs read....
"Samuel and Ann (Knowles) Tatum had a son Samuel, born June 20,
1647 and a
daughter Ann Tatum who married Joseph Todd, November 7, 1667.
Ann Knowles, the daughter of Damon and Ann, was bapt. Aug 8, 1628.
Joseph Todd was the son of John and Elizabeth (Mallory) Todd, and the newphew
of Joseph Todd, Treas. of the Bermuda Company."
Also note that one of John Todd's sons names a son of his own
"Mallory."
Pg 212 of the book "Bermuda Settlers of the 17th Century" by
Julia E. Mercer
shows Elizabeth Painter m. John Todd Feb 1668. She was the dau of Stephen
Painter (probably son of Stephen Paynter and
Alice Harrison). John Todd
buried March 19, 1678 in Port Royal. There are other mentions of
children of
John and Elizabeth as well as other Todds listed, probable kin. The Mercer
book, while it is a valuable reference, is not a primary source and
subject
to the author's mistakes and misperceptions.
Ibid, pgs 123-124 has a listing of the Mallory people. There is a
Horatio
Mallory m. Dorothy Forster 8 Aug 1629, son Horatio bapt. 8 Mar 1631. Later,
another Horatio is found to be a son of Edmund b June 20 1673.
The Mallorys are related to the Paynters through the Seymore
line.

I bequeath my soul to God my maker confidently believing in ___

the earth from which it came, desiring it may receive christian buriall.

At this point, I think it is only prudent to state that John Todd's wife
was
"Elizabeth the daughter of Elizabeth (maiden name unknown) Cuttrie", with the
annotation that Cuttrie may very well not have
been her first husband nor
Elizabeth's father.

1656: Probably her mother,
Elizabeth Paynter married a Cuttrie
after John Todd's death.
Not possible. Stephen Paynter died 1659 and mentioned wife Jane.

plate and pewter and linen and books bee equallie

her husband William Bullock my profit or take of _____ in the hall and
the best ___oon _____ with a silk fringe belonging
unto it and one needle-work cushion and two cushionstools,
and my still and all belongings to it, but if shee
decease before her husband, then I give these aforesaid goods unto her
children.

give and bequeath unto my daughter Ruth, the great chest that is in the
parlor, and two cushion stools, and a needlework cushion.
Item. I give unto my n___ Sybella Righton the
next Negro childe that shall bee borne of any of the Negroes belonging unto mee, and in case my said ___ doe desire to change the said
child if it be a male fro a female, my will is that shee shall have the next female childe that shall belong
unto mee for the said male childe and that the said
child shall bee nursed for her at the charge of my executrix, till it be twelve
months ould. Moreover I give unto the said Sibella one cushion stoole.
Item. I doo
give unto Elizabeth, the wife of John Todd my rosestill,
in case shee doe outlive my wife.
Item. I doo hereby ordaine my deere
and loving wife Jane Painter aforesaid my full and whole executrix of
this my will and also doo ordaine and make my sonne Florentius Seymor and Capt Thomas Richards overseers for
the taking hand and seeing to the fullfilling of this
my will after her decease. And as a pledge of my love I give unto each of my
executors a silver ring. To my sonne
Seymor a ____ with a foot, and to Capt Richarda a low ___ with two oares.
It is my will that my
executrix during her life shall pay unto my overseers for the use of my
daughter, the late wife of my sonne Stephen
deceased and her children, five pounds ___ of annm

her care and industrie may dispose of it to whom shee pleaseth.
